1. Customer’s Responsible and Lawful Conduct
1.1 Compliance with Law
Customer commits to using the service only for purposes that comply with Finnish law, EU legislation, and good practice (i.e., accepted ethical standards). The customer is responsible for ensuring that all material, content, and activities stored or transmitted through the Service are lawful in all respects.
1.2 Prohibited Content and Activities
Service strictly prohibits storing, transmitting, or offering:
- Material that infringes on copyrights, trademarks, or other intellectual property rights.
- Material that is unlawful, discriminatory, threatening, defamatory, libelous, racist, or contains unlawful incitement to violence or hatred. Also all kind of pornographic content is prohibited.
- Material that infringes on privacy rights or contains personal data without an appropriate legal basis.
- Activities that disrupt or harm the Service Provider’s network, equipment, or other services (e.g., spamming, denial-of-service attacks (DDoS), or distribution of malware).
- Content that is contrary to good practice or the intended purpose of the Service.
1.3 Accuracy of Customer Data
The customer is obliged to provide Webialisti with accurate and up-to-date customer and contact information when placing an order and to keep this information updated throughout the contract period.
2. Breach of Contract and Suspension of Service
2.1 Breach of Contract
If the customer breaches these terms, Webialisti has the right to:
- Require the customer to remedy the breach immediately.
- Suspend the Service immediately without separate notice if the breach is severe, continuous, or if it causes immediate danger or harm to the operations of the Service Provider or third parties (e.g., unlawful or security-compromising activity).
- Terminate the contract immediately if the Customer fails to remedy the breach within the set deadline or if the breach is of such a nature that it cannot be remedied.
2.2 Obligation to Compensate
The customer is obliged to compensate Webialisti for all direct and indirect damages and costs (including legal costs) incurred by the Service Provider due to the customer’s actions or omissions that are contrary to these terms, law, or good practice.
3. Liability and Limitation of Liability of Webialisti
3.1 Content of Service
Webialisti is not obligated to pre-screen or monitor the content stored by the customer in the service without separated agreement and order for that kind of service. Webialisti acts purely as a technical intermediary.
3.2 Limitation of Liability
Liability for damages of Webialisti is limited to a maximum of the total amount of service fees paid by the customer during the preceding three (3) months. The Service Provider is not liable for indirect or consequential damages incurred by the customer, such as lost profits or data. The limitation of liability does not apply to damages caused intentionally or by gross negligence.
4. Other Terms
- These General Terms and Conditions apply to the hosting services provided by Webialisti and the customer’s use thereof. By using the service, the customer agrees to comply with these terms.
- Amendments to the terms: Webialisti reserves the right to amend these terms. Customer will be informed of any changes on the website of Webialisti or by phone call or message. The changes will become effective on the date specified in the notice.
- Webialisti sales service only from request from the customer and after getting know with the customer and it’s purposes to use service provided by Webialisti service will be launched. Every order will be managed after conversation and agreements made together with the customer.
